Our Privacy Commitment
1. INTRODUCTION the4all is committed to protecting your privacy and security. This policy explains how and why we use your personal data, to ensure you remain informed and in control of your information. From April 2018, the4all will ask its customers to "opt-in" for marketing communications. This is due to a change to the rules which govern how we can communicate with you and a new regulation on personal data (the General Data Protection Regulation) coming into force in May 2018. Therefore we are introducing a new approach that relies on you giving us your consent about how we can contact you. This means you’ll have the choice as to whether you want to receive these messages and be able to select how you want to receive them (email, phone, SMS or post). You can decide not to receive communications or change how we contact you at any time. ABOUT US Your personal data (i.e. any information which identifies you, or which can be identified as relating to you personally) will be collected and used by the4all who control that data. 3. WHAT INFORMATION WE COLLECT Personal data you provide We collect data you provide to us. This includes information you give when registering online, placing an order or communicating with us. For example: personal details (name, email, address, telephone etc.) and details of your orders and delivery addresses. Data that we automatically collect We collect data that we receive based on your use of our services such as the product creator tools, your visit to our website and possibly other websites which are accessible from our Website. We collect your IP address and the type of browser you use, but also the date and time of your visit how you make use of our website. Information we generate We may conduct research and analysis on the information we hold, which can in turn generate personal data. For example, by analysing your orders we may be able to build a profile which helps us decide which of our communications are likely to interest you. Section 7 (Research and profiling) contains more information about how we use information for profiling and targeted advertising. Information from third parties We may use third parties to help us conduct research and analysis on personal data (and this can result in new personal data being created). Also, as explained in Section 11 (Cookies and links to other sites). We may collect information from social media where you have given us permission to do so, or if you post on one of our social media pages. When assessing applications for credit accounts or trade users accounts we may collect information from third parties including public databases (such as Companies House), other businesses or credit rating agencies. Sensitive personal data We do not normally collect or store sensitive personal data (such as information relating to health, beliefs or political affiliation). However there are rare situations where this may occur. If this does occur, we’ll take care to ensure your privacy rights are protected. Accidents or incidents If an accident or incident occurs on our property or involving one of our staff then we’ll keep a record of this (which may include personal data and sensitive personal data). 4. HOW WE USE INFORMATION We only ever use your personal data with your consent, or where it is necessary in order to: enter into, or perform, a contract with you; comply with a legal duty; protect your vital interests; for our own (or a third party’s) lawful interests, provided your rights don’t override these. In any event, we’ll only use your information for the purpose or purposes it was collected for. Marketing We use personal data to communicate with people and to promote the4all. This includes keeping you up to date with our news, updates and product information. For further information on this please see Section 6 (Marketing). Administration We use personal data for administrative purposes. This includes: performing our obligations under sales contracts; fulfilling orders for goods or services (whether placed online, by post, over the phone or in person); helping us respect your choices and preferences (e.g. if you ask not to receive marketing material, we’ll keep a record of this). Customer research and analysis We carry out research and analysis on our customers, to determine the success of marketing campaigns, better understand behaviour and responses and identify patterns and trends. This helps inform our approach towards marketing and make the4all a stronger and more effective company. Understanding our customers and what they care about also helps us provide a better experience (e.g. through more relevant communications). 5. DISCLOSING AND SHARING DATA We will never sell your personal data. If you have opted-in to marketing, we may contact you with information about our partners, or third party products and services, but these communications will always come from the4all. We may share personal data with subcontractors or suppliers who provide us with services. For example, if you order something from the the4all, your name and address will be shared with the delivery company or where a product ordered is supplied and dispatched directly to you by a third party. 6. This includes all our marketing communications (the term marketing is broadly defined and, for instance, covers information about products, services and offers). When you receive a communication, we may collect information about your response to or interaction with that communication, and this may affect how we communicate with you in future. 7. RESEARCH AND PROFILING This section explains how and why we use personal data to build profiles which enable us to understand our customers, improve our relationship with them, and provide a better customer experience. Analysis and grouping We analyse our customers to determine common characteristics and preferences. We do this by assessing various types of information including behaviour (e.g. previous responses) or demographic information (e.g. location). By grouping people together on the basis of common characteristics, we can ensure that group is provided with communications, products, and information which is most important to them. This helps prevent your inbox from filling up, and also means we aren’t wasting resources on contacting people with information which isn’t relevant to them. 8. HOW WE PROTECT DATA We employ a variety of physical and technical measures to keep your data safe and to prevent unauthorised access to, or use or disclosure of your personal information. Electronic data and databases are stored on secure computer systems and we control who has access to information (using both physical and electronic means). Our staff receive data protection training and we have a set of data protection procedures which personnel are required to follow when handling personal data. CCTV Our premises have CCTV and you may be recorded when you visit in person. CCTV is there to help provide security and to protect both you and the4all. CCTV will only be viewed when necessary (e.g. to detect or prevent crime) and footage is only stored temporarily. Unless it is flagged for review CCTV will be recorded over. the4all complies with the Information Commissioner’s Office CCTV Code of Practice, and we put up notices so you know when CCTV is in use. 9. STORAGE Where we store information the4all operations are based in the UK and use web servers based in UK data centres, however some organisations which provide services to us may transfer personal data outside of the UK, but we’ll only allow them to do so if your data is adequately protected. For example, some of our systems use Microsoft products and cloud storage. As a US company, it may be that using their products result in personal data being transferred to or accessible from the US. However, we’ll allow this as your personal data will still be adequately protected (as Microsoft is certified under the USA’s Privacy Shield scheme and meets EU General Data Protection Regulation standards). How long we store information We will only use and store information for so long as it is required for the purposes it was collected for. How long information will be stored for depends on the information in question and what it is being used for. For example, if you ask us not to send you marketing emails, we will stop storing your emails for marketing purposes (though we’ll keep a record of your preference not to be emailed). We continually review what information we hold and delete what is no longer required. We never store payment card information. 10. KEEPING YOU IN CONTROL We want to ensure you remain in control of your personal data. Part of this is making sure you understand your legal rights, which are as follows: the right to confirmation as to whether or not we have your personal data and, if we do, to obtain a copy of the personal information we hold (this is known as subject access request); the right to have your data erased (though this will not apply where it is necessary for us to continue to use the data for a lawful reason); the right to have inaccurate data rectified; the right to object to your data being used for marketing or profiling; and where technically feasible, you have the right to personal data you have provided to us which we process automatically on the basis of your consent or the performance of a contract. This information will be provided in a common electronic format. Please keep in mind that there are exceptions to the rights above and, though we will always try to respond to your satisfaction, there may be situations where we are unable to do so. Terms & Conditions
All orders for goods accepted by the4all ('the vendor') are accepted subject to the following conditions which shall form part and govern the contract of sale. Placing an order for goods shall be deemed to be acceptance of these conditions of sale. Any term sought to be imposed by a purchaser either in a document or otherwise that conflicts with or adds to these conditions is not accepted. No agent or representative of the vendor has authority to vary these conditions unless accepted and confirmed in writing. 1. Warranty - The purchaser shall at the time the proof approval is approved be deemed to have carried out his own investigations and/or tests of the goods and therefore accepts and acknowledges that he has not relied upon the skill or judgment of the vendor in entering into this Contract. Any information, data or advice furnished to the purchaser shall not be deemed to form part of the Contract and the vendor can accept no liability for any inaccuracies in such information, data or advice (whether or not such inaccuracies result from the vendors negligence), nor for any losses, direct or indirect, arising out of or consequent upon or attributable to the purchasers or any third parties' having made use of or adopted in whole or in part any such information, data or advice given (whether negligently or otherwise) by or on behalf of the vendor. 2. Dispatch (a) The vendor will dispatch goods on the purchasers behalf using a third party courier, once goods are collected, the couriers terms and conditions shall apply (terms available on request). The vendor is not able to guarantee time or date of delivery. (b) The purchaser shall be responsible for any additional costs incurred when goods are not able to be delivered to the delivery address provided. (c) The purchaser shall be responsible for any additional costs incurred where delivery instructions provided dictate specific details outside of the couriers standard terms and contions, including (without limiting the foregoing) specific delivery time ranges, specific delivery dates, pre-booking a delivery, limitations on delivery sizes and special packing requirements. The vendor reserves the right in these circumstances to request collection of such orders by the purchaser (or their agent) at the purchasers cost. (d) The purchaser may arrange collection of goods provided this is notified and agreed in writing at time of order. (e) Where the purchaser does or take delivery of goods when the same are ready for collection or delivery and the vendor has taken reasonable steps to advise the purchaser, the vendor shall store the goods for a maximum period of 60 days from production date (storage space permitting) and they will then be disposed of. The purchaser will be liable for any storage and disposal costs. 3. Property and Risk - For so long as any amounts remain owing from the purchaser to the vendor (whether immediately due or not) title to the property of the goods shall remain with the vendor and ownership will not pass to the purchaser until the vendor has received payment in full. In the event of the purchaser reselling the goods, if the vendor has not received all amounts owing, the purchaser shall account to the vendor for the proceeds of any such sale and meanwhile will hold all proceeds of such sale of such goods upon trust of the vendor until the vendor has received such amounts in full. The vendor shall have the right to trace all proceeds. At any time after the due date for payment from the purchaser to the vendor and so long as such amounts have not been received by the vendor in full, the vendor, at the purchaser’s expense, shall have the right to enter the purchaser’s premises and remove there from all goods which remain the property of the vendor. 4. Returned Goods (a)The vendor will not accept goods for credit or rectification unless such return has been authorized in writing and the goods are received by the vendor in stock condition, with original packaging. The vendor retains the right at its sole discretion whether to accept the return of the goods or whether to rectify the goods or to issue a credit note in respect thereof. The vendor reserves the right to charge a restocking fee on goods returned for credit. (b)The purchaser shall unless otherwise stated be responsible for the cost of outward and return carriage and insurance of all goods returned by the purchaser to the vendor for service or credit. These goods shall be at the risk of the purchaser until actual receipt of the goods by the vendor. The onus of proof of safe delivery shall rest with the purchaser. (c)All items returned to the vendor by prearrangement and found to contain no fault, will be subject to a 10% handling charge (minimum charge £10). (d)No credit shall be allowed for goods until they have been received complete. (e)The vendor will not accept custom printed or customized goods for credit. (f)The vendor will not accept goods for credit that have subsequently been printed or customized. 5. Consequential Loss - The extent of the vendor liability to the purchaser for any default or breach whatsoever and howsoever arising shall in no case exceed the invoice value of the goods and the vendor shall in no circumstances whatsoever be liable to the purchaser in respect of any loss or damage whether suffered by the purchaser or any purchaser of the purchaser and whether direct, indirect, consequential or however else arising. 6. Availability of Goods. (a)The vendor will use its best endeavours to comply with the date named for dispatch which date is given and intended as estimate only and is not to be the essence of the contract. (b)The vendor’s acceptance of Express Orders is subject to written confirmation of acceptance following proof approval and payment. (c)Express service orders, if owing to non-availability of the goods, materials, delivery failure or any other causes, the vendor shall be unable to affect delivery at the specified time, the total extent of the vendors liability will be to refund the express service charges only, and no other claims will be accepted in this regard. (d)Force Majeure. The vendor shall be under no liability if unable to carry out any provision of the contract for any reason beyond his control including (without limiting the foregoing) Act of God, legislation, war, fire, flood, drought, failure of power supply, adverse weather, lockout, strike or other action taken by employees in contemplation or furtherance of a dispute or owing to any inability to precure materials required for the performance of the contract. During the continuance of such a contingency, the customer may by written notice to the vendor elect to terminate the contract and pay for work done and materials used but subject there to shall otherwise accept delivery when available. 7. Payment and Price (a)No work will be undertaken by the vendor until the purchaser has completed an order form. (b)Payment for all goods and services is due prior to scheduling for production. (c)All Express orders must be paid for in full, online, by credit/debit card at time of approval. (d)The vendor reserves the right to supply any order, that is not paid for in full online at the time of approval, on standard service timescales. (e)All artwork, setup and cancellation charges (and any other work carried out prior to approval) are chargeable and must be paid for in full within 28 days of receipt, regardless of the order status. (f)The vendor reserves the right to vary the quoted price for the goods by upward additions in accordance with market conditions at the date of approval and the purchaser shall pay such additions in addition to the quoted price. Price Lists do not constitute an offer. (g)All overdue accounts will be charged, on a daily basis, commercial interest at 5% above the base rate of Nat West Bank plc pertaining at the time. (h)All prices exclude VAT 8. Design Variation - Whilst the vendor makes every effort to ensure that goods supplied correspond to in every respect with the sample, specification or description provided as the case may be, the vendor is not responsible for the minor variations in specification, in colour or other design features, and no such minor variation shall entitle the purchaser to rescind the contract or shall be the subject of any claim against the vendor by the purchaser. 9. Order cancellation (a)All orders cancelled prior to final approval are subject to a cancellation charge displayed at time of order. (b)Once an order is approved and paid the vendor is not able to accept cancellation under any circumstances. 10. Claims (a)The purchaser shall inspect the goods immediately on delivery and shall within 72 hours of such delivery (time to be of the essence) give notice in writing to the vendor of any claim for shortage, damage or non-functionality. Any delivery book or note marked "NOT EXAMINED" will not prevent the operation of this sub-clause nor constitute notice in writing within its terms. (b)No liability for any claim for missing items shall be accepted unless the vendor is notified in writing by the purchaser within 72 hours of delivery. (c)No liability for any claim will be accepted in the case of goods differing in quantity or descriptions from the particulars given on the delivery note unless the vendor is notified in writing by the purchaser within 72 hours of delivery and the onus is on the purchaser to prove any shortage. (d)In the case of manufacturers who operate direct product support and returns procedures, the purchaser accepts an obligation to process their claim directly through the manufacturer. 11. Guarantee - The purchaser shall, unless otherwise in writing, be responsible for all carriage, telephone, postal and other incidental charges incurred during the guarantee period. 12. Size, Weights etc (a) All sizes stated are nominal and are subject to dimensional tolerances in accordance with appropriate B.S.S. (b) The vendor may deliver to the purchaser an excess and/or deficiency of up to 10 per cent of weight or volume agreed to be delivered without any liability to the purchaser whatsoever save that the price payable by the purchaser shall be adjusted accordingly. 13. Patents and Trademarks - No representation is made or warranty given that any goods supplied do not infringe any letters patent, trademarks, registered designs or other similar industrial rights. The vendor shall not be required to print any matter which in his opinion is or may be of an illegal or libelous nature or an infringment of the proprietary or other rights of any third party. The vendor shall be indemnified by the customer in respect of any claims, cost and expenses arising out of any libelous matter or any infringement of copyright, patent, design or of any other proprietary or personal rights contained in any material printed for the purchaser. The indemnity shall extend to any amounts paid on a lawyers advice in settlement of any claim. 14. Use of products for marketing - the vendor reserves the right to use products and images of products produced for the purchaser, for its own advertising and sampling purposes unless advised in writing by the purchaser, at time of order, to the contrary. 15. Law (a)If any part of these terms and conditions shall be found to be unlawful it shall not affect the validity or enforceability of the remainder of the conditions. (b)This contract is and shall be deemed to have been made in England and shall in all respects be governed by English Law. 16. Payment - The4all accepts payment as follows: Credit/Debit Card - We accept all major credit/debit cards excluding amex. Surcharges for credit cards are not normally made but we reserve the right to do so, on certain orders. Cheques - Orders paid by cheque, may not be scheduled for production and will not be dispatched, until the cheque has cleared. Foreign cheques must be drawn on a UK bank in Sterling; otherwise further charges may be made. Bank Transfer - We can accept CHAPS and BACS transfers.
